A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.
In her decision, the judge pointed out that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
