The NBA legend Testifies He Felt No Fear of Nascar in Antitrust Trial

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, admitted that his competitive side and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Financial Stakes and a Competitive Drive

The owner disclosed financial and corporate details of his 23XI team, revealing he put in $40 million of his own funds into the Cup Series operation launched with business partner Curtis Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated during testimony. “As a newcomer, I had no fear. I felt I could challenge Nascar in its entirety. I felt as far as the sport required examination through a new lens.”

The Core Dispute: Franchise System and Contract Pressure

The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a franchise. This system mirrors other professional sports with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded teams renew their charters.

Jordan testified for an hour and exited the courthouse to pandemonium, with fans and media clamoring for a view or a photo of the sports legend.

Leading the Legal Charge

Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan said is breaking the law to maintain excessive control.

At issue for Jordan and Heather Gibbs, who preceded Jordan, are events from last September. Gibbs described a hectic and tense six hours where the racing circuit told teams they must sign a charter agreement extension. The document consists of over a hundred pages detailing pay for chartered teams and a guaranteed spot in Nascar-sponsored races.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports concluded their only feasible option was to decline to sign that extensive document and take the issue to court. All other teams agreed to the terms.

The team owners approached Nascar about possible changes or extension options. Nascar wasn’t talking, according to his testimony.

The Bottom Line: Winning

Ultimately, the resistance against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Success.

“Hamlin persuaded me getting a third driver boosted our odds of winning,” he testified, sharing that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I took the plunge.”

Account from the Gibbs Family

Gibbs described her request for permanent charters, submitted in a written letter to Nascar. She testified the pressure of the signature deadline was problematic.

She said, the team founder first attempted to call and persuade Nascar against demanding signatures, but CEO Jim France refused the appeal.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, I have 20. If I have 30, I have 30.”
