Czech Republic's Populist PM-Elect Declines to Divest Business Empire Amid Ethical Dispute

Andrej Babiš, the self-styled billionaire that secured victory in last month's parliamentary vote, has refused to offload his extensive corporate assets, while asserting he will address a conflict of interest that might block him from assuming the role of head of government.

Stance on Corporate Empire

Babiš, whose political movement emerged victorious in the autumn vote but did not secure a majority in parliament, declared in a online statement that he would not divest his Agrofert conglomerate, which operates in agriculture, food processing, and chemicals.

“I have repeatedly said I will never sell Agrofert. I have consistently said I will resolve the conflict of interest in compliance with national and European laws,” Babiš remarked. “This is different from selling a pastry in a bakery.”

President's Requirement

The head of state, Petr Pavel, announced that the elderly political figure must publicly explain how he will eliminate conflicts of interest stemming from his corporate dealings before being appointed premier.

The national charter “explicitly requires the president to consider the possible emergence of a ethical issue and the possibilities for its resolution” when appointing cabinet members, the presidential administration explained.

The head of state “wants it to be clear in what precise manner Andrej Babiš will fulfil his constitutional and legal obligations”, the statement said, noting that Pavel was ready to designate Babiš as prime minister “immediately” once the matter was resolved.

Corporate Activities and Regulatory Concerns

Babiš's numerous companies, primarily under the Agrofert group, function in the nation and other regional countries, receiving millions of euros in domestic and European agricultural and other grants, as well as government deals.

Under national legislation, cabinet members are barred from receiving public aid or agreements. The ethics organization Transparency International has stated that to prevent a ethical breach, Babiš must either sell, refuse government deals, or stay out of government.

Previous Term and Current Plans

Babiš said he would “follow the regulations” if selected as premier, but did not want to detail how in beforehand because the issue was “an highly personal and private affair for me, and journalists will invariably criticise me regardless”.

During his initial tenure as premier, from 2017 to 2021, Babiš faced several court cases and an EU investigation over potential ethical issues. He temporarily moved his holdings into fiduciary arrangements, while retaining certain control over them.

A court and the European Commission both ruled that this did not suffice. Babiš stated last month that he was once more the sole owner of Agrofert and maintained he was “implementing measures” to avoid a conflict of interest, but declined to disclose specifics.

Governing Deal and International Implications

The wealthy politician has signed a coalition agreement with two rightwing fringe parties, the far-right, Russia-friendly SPD, which has called for a referendum on exiting the EU, and the Motorists for Themselves, which has mainly campaigned against the EU’s environmental policy.

The incoming administration, if confirmed, is likely to bolster the populist bloc in central and eastern Europe and could challenge western support for Ukraine – although Babiš has called Ukraine’s president, Volodymyr Zelenskyy, to confirm of Czech support.

Pavel, who as head of state has a role for foreign policy, also requested that the coalition’s programme include a declaration on the government’s position on Russia’s war in Ukraine, including a commitment to fulfilling alliance duties.

The president has earlier said he would not approve any cabinet candidates who might question the nation's EU and Nato commitments, a condition that the far-right SPD has said it will meet by proposing non-partisan experts.
